Hayli Terms of Use

1    Parties

Hayli application (“Application”) and Hayli web site “Hayli.io” (Website) are provided by Ardıç Ar-Ge Bilgi ve Teknoloji Çözümleri Anonim Şirketi (“ARDIC”).
Users understand that these Terms of Use (hereinafter, referred to as “Terms”) shall be effective as of their approval and that they are obliged to comply with the provisions set out in these Terms.
In these Terms, ARDIC and the Users shall separately be referred to as “Party” and as “Parties” collectively.

2    Subject of the Terms

The subject of these Terms is to determine the rights and obligations of the Parties with respect to the Users’ use of the Application and the Website which are being provided by ARDIC via Google Play and Apple Appstore.

3    Rights and Obligations of the Parties

3.1.    The Application and Website are open to anyone on condition that they use the Application and Website in compliance with particularly these Terms, the terms set forth by ARDIC that are published on the Application and Website and with the relevant legislation. The User undertakes that he/she shall comply with these Terms and its annexes, other terms published on the Application and Website which are determined by ARDIC, and laws, ethics and manners and principle of honesty with respect to any of his/her activities to be carried out in the Application and Website.
3.2.    The User shall be solely responsible for the use and management of any information that enables use of the Application and Website and for keeping his/her password confidential and secure. Any activity carried out via the User’s account shall be considered as carried out by the User and the User shall be solely liable for the damages incurred by the User and/or third parties in consequence of the use of such information by any person other than the User, or loss or handover of such information.
3.3.    The User shall first download a special program (“Application”), which is provided via a web link such as Google Play to be notified to the User, to his/her mobile device (tablet, smartphone etc.) (“Device”) to use the Software in his/her Device.
3.4.    The User accepts that he/she is aware that the security software he/she is using may interfere with the operation of the Software, and therefore the Software may not operate, and he/she may experience underperformance. The User is solely liable for inspecting whether the Device and other software and applications on the Device have features that may interfere or limit the use of the Software. The User agrees that ARDIC shall not be held liable, and he/she shall be solely responsible if he/she does not exercise such inspections or even though he/she does so, that the use of the Software interlocks the Device due to the features of the Device.
3.5.    Rules with respect to the User information are set forth in the Privacy Policy. ARDIC shall not use the User information out of the scope stated in these Terms and the Privacy Policy and shall not disclose such information to third parties. In some cases, ARDIC may collect non-personal data which is specific to the Device via cookies. Such data is used for understanding the User better and enhancing the utility, performance and operation of the Application and Software. The User acknowledges that he/she permits the use of said data in such way.
3.6.    The User shall bear any legal, administrative, or criminal responsibility that may arise from the use of the Application and Software. ARDIC shall not be held responsible, directly, or indirectly for any manner whatsoever, for the damages that may be incurred by third parties in consequence of the activities of the User carried out via the Application or Website, and/or of his/her breach of these Terms or law. Any claims to be submitted by third parties within this scope, and damages that may arise from the failure of the User to perform his/her obligations specified in the Terms shall be recourse to the User.

4    Intellectual Property Rights

4.1.    All monetary, moral and commercial rights of ARDIC’s system, Website, and Application including but not limited to the images and designs, scripts, logos, graphics on the Website, and/or Application shall belong to ARDIC. ARDIC agrees to grant the non-exclusive and non-assignable right of use, on the part of the software offered via the Application to the User, and such limited right of use granted to the User shall not be interpreted against ARDIC.
4.2.    The User shall only use the Application within the scope of these Terms. The User shall not lend such rights, provide for the use of third parties (individual, organization, corporation, company etc.) at cost like renting or at no cost, and make such right available to third parties. Within this framework, it shall be strictly prohibited to copy or reproduce the information, content and/or software used by ARDIC within the Application, use such information, content and/or software beyond the scope stated in these Terms and distribute, or process such information, content and/or software. The User shall also be strictly prohibited from carrying out activities that may threaten the security of the Application or Website ARDIC systems and/or cause damage to the Application, ARDIC and other users; make any attempts that may hamper the operation of the Application or Website and other software with respect to the Application or other Users’ use of the Application and Website, or put disproportionate load to the system or Application which may cause the aforementioned problems; gain unauthorized access to the information published on the Application or Website and/or inputted by other persons to the Application or Website, or to the source codes of the software or ARDIC’s systems; copy, remove, change said information or make any attempts to do so; use any software that may restrain the operation of the Application and/or Website, make any attempts to use such software or disrupt the operation of any kinds of software, hardware and servers, cause breakdown of such software, hardware and servers, reverse engineer, attack, keep occupied or interfere with such software, hardware and servers in any other manner; or endeavor to access the ARDIC servers. The User agrees that he/she shall not compete with ARDIC, the Application, in the abovementioned manners or by any other means, and that he/she shall not support third parties who intend to do so.
4.3.    Any components of the Application or Website shall not be published in any media in any way including but not limited to written, oral and/or electronic ways, and/or links to such shall not be provided without ARDIC’s consent.

5     NFT Creator Notice, NFT Risk Notice

If you are using Hayli to create, mint, sell, trade, or otherwise distribute NFTs, and/or any other cryptographic assets, the prices and value of NFTs may fluctuate significantly. User acknowledges and fully understands the risks associated with purchasing and/or selling NFTs.

6    Limitation of Liability

6.1.    The Application and Website are being offered “as is” by ARDIC, and ARDIC does not provide any claim or commitment with regard that the Application and Website are error-free, indefectible, and perfect, or fulfil the User’s personal needs.
6.2.    ARDIC shall not be responsible foarise; accordingly, issue of the Application and Website by the User, the results and damages resulting from the User’s failure to fulfill his/her commitment and obligations; special, accidental or consequential damages which may arise out of such failure; the resulting economic damages; all kinds of profit loss, data loss, business loss, loss of reputation, loss of expected savings, loss of income and all kinds of material and non-pecuniary damages, third party claims for indemnification; (ii) all hardware, systems software/other software and network related function and defaults that might arise accordingly; (iii) defaults on the network, internet connection, design and connection; (iv) all kinds of changes, updates and similar actions that might be made by the User or third parties on the Application and Software; (v) damages arising from voltage fluctuation, electrical power cuts, virus attack, and similar environmental factors. The User agrees that in case of any interruption especially the internet cut off, he/she may not be able to use his/her Device in the usual way immediately, it may be required to restore the factory setting to use the Device in its usual way, and that in such case ARDIC shall not be liable for any loss or damages particularly the data loss.
6.3.    TO THE EXTENT ALLOWED BY APPLICABLE LAW, ARDIC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHICH MAY BE INCURRED AS A RESULT OF THE USE OF THE WEBSITE OR SOFTWARE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, LOSS OF GOODWILL OR BUSINESS REPUTATION. FEATURES AND OTHER CONTENTS IN THE APPLICATION AND SOFTWARE ARE BEING OFFERED “AS IS” AND ARDIC DOES NOT PROVIDE ANY COMMITMENT OR UNDERTAKING WITH REGARD TO THE AUTHENTICITY, ACCURACY OR SECURITY OF SUCH. FURTHERMORE, ARDIC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE OR NON-BREACH. IN ANY EVENT, ARDIC’S LIABILITY ARISING FROM THESE TERMS TOWARDS THE USERS SHALL BE LIMITED TO THE TOTAL AMOUNT OF THE INVOICE ISSUED IN THE EVENT THAT THE USER IS PURCHASED A GOOD OR SERVICE.  
6.4.    No Responsibility for NFTs or Collectibles; No Guarantee of Uniqueness or IP. ARDIC has no responsibility for Collectibles that Users trade via Hayli. ARDIC does not investigate and cannot guarantee or warrant the authenticity, originality, uniqueness, marketability, legality, or value of any Collectibles that Users trade on Hayli. The Collectible ID of an NFT and the content embodied therein specifies the properties of the NFT and the content embodied therein, including the name and description of the NFT and the content embodied therein (the “Collectible Descriptors”), a URI identifying any image file associated with the Collectible (the “Collectible Image”) and potentially other “metadata” associated with the Collectible (the Collectible Descriptors, Collectible Image and such other metadata, collectively, the “Collectible Metadata”). The Collectible Metadata for Collectibles that are created through the ARDIC Applications or Web sites may be stored on InterPlanetary File System (“IPFS”) through a third-party distributed cloud service (e.g., Pinata) or a third-party storage chain (e.g., Filecoin). The Collectible Metadata for Collectibles that are created outside the ARDIC Applications or Websites may be stored in other ways, depending on how such Collectibles were created. There can be no guarantee or assurance of the uniqueness, originality, or quality of any Collectible or Collectible Metadata. In the absence of an express legal agreement between the User of any Collectibles and purchasers of Collectibles, there cannot be any guarantee or assurance that the purchase or holding of Collectibles confers any license to or ownership of the Collectible Metadata or other intellectual property associated with Collectibles or any other right or entitlement, notwithstanding that you may rightfully own or possess the Collectible. ARDIC may from time to time remove certain Collectibles from the App or Web Site or restrict the creation of Collectibles on the App in ARDIC’s sole and absolute discretion, including in connection with any belief by ARDIC that such Collectibles violate these Terms. ARDIC does not commit and will not be liable for any failure to support, display or offer or continue to support, display, or offer any Collectibles for trading through Hayli. 
6.5.    The User acknowledges and declares that links to the websites which are not controlled by ARDIC and/or platforms, files or contents may be given via the Application, third party services may be offered, and that such links shall not be considered as provided for purposes of support to the website or its operator, or as undertaking or guaranteeing anything with regard to the website or its content, ARDIC shall not be liable for the platforms, websites, files and contents, services or goods or their content.
6.6.    No Professional Advice or Liability. All information provided by or on behalf of ARDIC is for informational purposes only and should not be construed as professional, accounting, or legal advice. You should not take or refrain from taking any action in reliance on any information contained in these Terms or provided by or on behalf of ARDIC. Before you make any financial, legal, or other decisions involving Hayli, you should seek independent professional advice from people licensed and qualified in the area for which such advice would be appropriate. You must always use caution when giving out any personal information to other Users or third-party linked websites through Hayli. ARDIC does not control or endorse User Content, any third-party content, messages, or information found in Hayli and ARDIC will not be liable for any use or misuse of User Content by any User. ARDIC specifically disclaims any liability with regard to Hayli and any actions resulting from your use of Hayli.
6.7.    Disclaimers Related to Blockchain Technology. To the maximum extent permitted by applicable law, and notwithstanding anything otherwise expressly provided herein, ARDIC disclaims all liability related to the following: (a) Use of Blockchain Technology. ARDIC utilizes experimental cryptographic and blockchain technologies, including tokens, cryptocurrencies, stablecoins, “smart contracts,” consensus algorithms, voting systems and distributed, decentralized or peer-to-peer networks or systems in providing Hayli. You acknowledge and agree that such technologies are novel, experimental, and speculative, and that therefore there is significant uncertainty regarding the operation and effects and risks thereof and the application of existing law thereto. To the maximum extent permitted by applicable law, ARDIC disclaims all liability related to the foregoing. (b) Certain Risks of Blockchain Technology. The technology utilized in delivering Hayli depends on public peer-to-peer networks such as the ARDIC-Supported Blockchains that are not under the control or influence of ARDIC and are subject to many risks and uncertainties. ARDIC may have limited or no ability to change these technologies, other than ceasing to support certain “smart contracts” and adding support for new “smart contracts”. ARDIC does not guarantee and is not responsible for your ability to exercise their rights with respect to such Collectible or any other applicable digital assets. (c) Certain Risks of Smart Contract Technology. NFTs and the content embodied therein and other digital assets relevant to Hayli depend on smart contracts deployed to ARDIC-Supported Blockchains, and some may be coded or deployed by persons other than ARDIC. Once deployed to ARDIC-Supported Blockchain(s), the code of smart contracts cannot be modified. If applicable smart contracts are adversely affected by malfunctions, bugs, defects, malfunctions, hacking, theft, attacks, negligent coding or design choices, or changes to the protocol rules of any ARDIC-Supported Blockchain, you may be exposed to a risk of total loss and forfeiture of all Collectibles and other relevant digital assets. (d) Asset Prices. The fiat-denominated prices and value in public markets of assets such as ETH, Collectibles, and other digital assets have historically been subject to dramatic fluctuations and are highly volatile. As relatively new products and technologies, blockchain-based assets are not widely accepted as a means of payment for goods and services. A significant portion of demand for these assets is generated by speculators and investors seeking to profit from the short- or long-term holding of blockchain assets. The market value of any ETH, Collectibles, and other digital assets may decline below the price for which you acquire such assets through Hayli or on any other platform. You acknowledge and agree that the costs and speeds of transacting with cryptographic and blockchain based systems are variable and may increase or decrease dramatically at any time, resulting in prolonged inability to access or use any ETH or other cryptocurrency, Collectibles, or other digital assets associated with Hayli. (e) Regulatory Uncertainty. Blockchain technologies and digital assets are subject to many legal and regulatory uncertainties, and Hayli, Collectibles, and other digital assets could be adversely impacted by one or more regulatory or legal inquiries, actions, suits, investigations, claims, fines or judgments, which could impede or limit your ability to continue the use and enjoyment of such assets and technologies. (f) Cryptography Risks. Cryptography is a progressing field. Advances in code cracking or technical advances such as the development of quantum computers may present risks to ARDIC-Supported Blockchain(s), Hayli, Collectibles, and other digital assets, including the theft, loss or inaccessibility thereof. (g) Fork Handling. Certain elements of Hayli, ARDIC-Supported Blockchains, NFTs, Collectibles, and other digital assets may be subject to “forks.” Forks occur when some or all persons running the software clients for a particular blockchain system adopt a new client or a new version of an existing client that: (i) changes the protocol rules in backwards-compatible or backwards-incompatible manner that affects which transactions can be added into later blocks, how later blocks are added to the blockchain, or other matters relating to the future operation of the protocol; or (ii) reorganizes or changes past blocks to alter the history of the blockchain. Some forks are “contentious” and thus may result in two or more persistent alternative versions of the protocol or blockchain, either of which may be viewed as or claimed to be the legitimate or genuine continuation of the original. ARDIC may not be able to anticipate, control or influence the occurrence or outcome of forks, and does not assume any risk, liability or obligation in connection therewith. Without limiting the generality of the foregoing, ARDIC does not assume any responsibility to notify you of pending, threatened, or completed forks. ARDIC will determine its response(s) to such forks in its sole and absolute discretion, without any duty or obligation or liability to you for such response (or lack of such response). ARDIC reserves the right to only allow one NFT to be associated with the relevant metadata forming the Collectible, notwithstanding that copies of such NFT may exist on both chains following a fork. You assume full responsibility to independently remain apprised of and informed about possible forks, and to manage your own interests in connection therewith. The User acknowledges and declares that the availability and quality of the Application and Website and contents provided via the Application substantially depend upon the service quality provided by the relevant Internet Service Provider and that ARDIC is not responsible for any problems arising from such service quality, that he/she is aware that the operation of the Software and Application is not error free, and that malfunctions or blocked access may from time to time occur.
6.8.    Age requirements and responsibility of parents and guardians: By accessing Hayli and ARDIC services, User confirms that he/she is at least 17 years old and meet the minimum age of digital consent in User’s country. ARDIC is not able to guarantee that the User’s age is accurate. If the User is old enough to access ARDIC services in User’s country but not old enough to have authority to consent to Hayli terms, User’s parent or guardian must agree to the terms on User’s behalf. If you’re a parent or legal guardian and you allow your teenager to use Hayli, then these terms also apply to you and you’re responsible for your teenager’s activity on Hayli.
User content is User’s, but User give Hayli and ARDIC a license to it when User uses Hayli. User content may be protected by certain intellectual property rights. Hayli doesn’t own those. But by using Hayli, User grants Hayli a license—which is a form of permission—to do the following with User content, in accordance with applicable legal requirements, in connection with operating, developing, and improving ARDIC services:
Use, copy, store, distribute, and communicate User content in manners consistent with use of Hayli. (For example, so Hayli can store and display User content.)
Publish, publicly perform, or publicly display User content if User chose to make it visible to others. (For example, Hayli can display User messages if User posts them in public servers.)
Monitor, modify, translate, and reformat User content. 
Sublicense your content, to allow ARDIC services to work as intended. (For example, so we can store your content with our cloud service providers.)
This license is worldwide, non-exclusive (which means you can still license your content to others), royalty-free (which means there are no fees for this license), transferable, and perpetual.
ARDIC reserves the right to block, remove, and/or permanently delete your content for any reason, including breach of these terms, our Community Guidelines, our other policies, or any applicable law or regulation.

7    Suspension and Termination of the Terms

7.1.    ARDIC may suspend the User’s use and/or utilization of the Application temporarily or permanently if the User fails to comply with these Terms and its annexes, the User’s activities constitute legal, technical and especially information security risks, the User harms the third parties’ individual and commercial rights, or he/she breaches his/her obligations with respect to the Application.
7.2.    ARDIC shall be entitled to suspend or terminate the Application and Website and/or these Terms at any time for a definite or indefinite period.

8    Dispute Resolution

With respect to the disputes that may arise regarding these Terms; provisions set out herein shall be applicable, with the laws of the Republic of Turkey to be applicable in the absence of any such provisions. The Courts and Execution Offices of Istanbul shall have jurisdiction in all disputes arising from the execution of these Terms.

9    Miscellaneous Provisions

9.1    In case of any force majeure event, ARDIC shall not be responsible for late or deficient performance of its activities specified in these Terms or failure to perform such activities. Including but not limited to acts of god, wars, mobilizations, fires, strikes, lockouts, problems arising from infrastructure, power cut and adverse weather conditions and similar reasons beyond the reasonable control of the Parties shall be interpreted as force majeure.Performances of the Parties shall be suspended throughout the period of the force majeure event. In the event that the force majeure lasts longer than 1 (one) month, the rights of this Agreement may be terminated by the party that cannot be performed.
9.2    The User shall not transfer these Terms of Use and/or the rights and obligations arising from the Terms of Use to third parties without the express written consent of ARDIC. ARDIC has the right to transfer these Terms of Use and the rights and obligations arising from the Terms of Use to third parties.
9.3    In case of disputes that may arise within the scope of these Terms of Use, ARDIC’s records (including records kept in electronic environment) will be accepted as evidence in accordance with Article 193 of the HMK (Law of Civil Procedure). 
9.4    ARDIC shall be entitled to amend these Terms and the Privacy Policy which is an annex to these Terms, and other conditions published in the Application at any time unilaterally. The User shall be responsible for monitoring such documents on a regular basis.

 

Hayli Kullanım Koşulları

1.    Taraflar

Hayli uygulaması (“Uygulama” veya “Hayli”) ve Hayli web sitesi “hayli.io” (Websitesi) Ardıç Ar-Ge Bilgi ve Teknoloji Çözümleri Anonim Şirketi (“ARDIC” veya “biz”) sunulmaktadır.
Kullanıcılar, bu Kullanım Koşullarının (bundan böyle “Koşullar” olarak anılacaktır) onayları ile yürürlüğe gireceğini ve bu Koşullarda belirtilen hükümlere uymakla yükümlü olduklarını kabul ederler. Bu Koşullarda ARDIC ve Kullanıcılar ayrı ayrı “Taraf” ve birlikte “Taraflar” olarak anılacaktır.

2.    Kullanım Koşullarının Konusu

Bu Kullanım Koşullarının konusu, ARDIC tarafından Google Play ve Apple Appstore üzerinden sağlanan Uygulama ve Websitesinin Kullanıcıların kullanımına dair, Tarafların hak ve yükümlülüklerini belirlenmesidir.

3.    Tarafların Hak ve Yükümlülükleri

3.1.    Uygulama ve Web Sitesi, Uygulama ve Web Sitesi'ni başta bu Koşullar olmak üzere, ARDIC'in Uygulama ve Web Sitesinde yayınlanan şartlarına ve ilgili mevzuata uygun olarak kullanmak kaydıyla herkese açıktır. Kullanıcı, Uygulama ve Websitesini kullanırken, bu Koşullar ve eklerine, ARDIC tarafından Uygulama ve Websitesinde belirlenecek diğer şartlara, yasalara, etik, görgü ve dürüstlük ilkelerine uyacağını taahhüt eder. 
3.2.    Kullanıcı, Uygulama ve Web Sitesinin kullanımını sağlayan her türlü bilginin kullanımından ve yönetiminden ve şifresinin gizli ve güvenli tutulmasından münhasıran sorumludur. Kullanıcı'nın hesabı üzerinden gerçekleştirilen her türlü işlem Kullanıcı tarafından gerçekleştirilmiş kabul edilecek olup, bu bilgilerin kullanıcı dışında herhangi bir kişi tarafından kullanılması sonucunda, veya bu tür bilgilerin kaybolması, devredilmesi durumunda, Kullanıcı'nın ve/veya üçüncü kişilerin uğrayacağı zararlardan münhasıran Kullanıcı sorumlu olacaktır.
3.3.    Kullanıcı, öncelikle Websitesi üzerinden sağlanacak Google Play veya Apple Appstore gibi uygulama dükkanlarına yönlendirecek bir bağlantı ile veya doğrudan uygulama dükkanlarından özel bir yazılımı (“Uygulama” veya “Hayli”) tablet veya telefon gibi sahip oldukları akıllı cihazlarına indirecektir.  
3.4.    Kullanıcı, kullanmakta olduğu güvenlik yazılımının Uygulama'nın çalışmasına müdahale edebileceğini ve bu nedenle Uygulama'nın çalışmayabileceğini ve performans düşüklüğü yaşayabileceğini bildiğini kabul eder. Cihaz ve Cihazdaki diğer yazılım ve uygulamaların, Uygulamanın kullanımını engelleyebilecek veya sınırlandırabilecek özelliklere sahip olup olmadığının incelenmesinden yalnızca Kullanıcı sorumludur. Kullanıcı, söz konusu incelemeleri yapmaması veya yapmasına rağmen cihaz özelliklerine bağlı olarak Uygulamanın kullanımının Cihazı kilitlemesinden ARDIC'ın sorumlu tutulamayacağını ve münhasıran kendisinin sorumlu olacağını kabul eder.
3.5.    Kullanıcı bilgilerine ilişkin kurallar Gizlilik Politikasında belirtilmiştir. ARDIC, Kullanıcı bilgilerini bu Koşullar ve Gizlilik Politikası'nda belirtilen kapsam dışında kullanmayacak ve bu bilgileri üçüncü kişilere açıklamayacaktır. Bazı durumlarda ARDIC, çerezler aracılığıyla Cihaza özel kişisel olmayan verileri toplayabilir. Bu veriler, Kullanıcıyı daha iyi anlamak ve Uygulama ve Yazılımın faydasını, performansını ve çalışmasını geliştirmek için kullanılır. Kullanıcı, söz konusu verilerin bu şekilde kullanılmasına izin verdiğini kabul eder.
3.6.    Uygulama'nın kullanımından doğabilecek her türlü hukuki, idari ve cezai sorumluluk Kullanıcı'ya aittir. ARDIC, Kullanıcı'nın Uygulama veya Web Sitesi üzerinden gerçekleştirdiği faaliyetler sonucunda üçüncü kişilerin uğrayabileceği zararlardan ve/veya bu ihlallerden doğrudan veya dolaylı olarak hiçbir şekilde sorumlu tutulamaz. Bu kapsamda üçüncü kişiler tarafından ileri sürülecek her türlü talep ve Kullanıcı'nın Koşullar'da belirtilen yükümlülüklerini yerine getirmemesinden doğabilecek zararlar Kullanıcı'ya rücu edilecektir.

4.    Fikri Mülkiyet Hakları

4.1.    ARDIC'a ait sistem, Web Sitesi ve Uygulama'nın, Site ve/veya Uygulama'da yer alan resim ve tasarımlar, yazılar, logolar, grafikler dahil ancak bunlarla sınırlı olmamak üzere tüm parasal, manevi ve ticari hakları ARDIC'e aittir. ARDIC, Uygulama üzerinden Kullanıcı'ya sunulan yazılımın münhasır olmayan ve devredilemez kullanım hakkını vermeyi kabul eder. Kullanıcıya tanınan bu tür sınırlı kullanım hakkı ARDIC aleyhine yorumlanmaz. 
4.2.    Kullanıcı, Uygulamayı yalnızca bu Koşullar kapsamında kullanacaktır. Kullanıcı bu hakkı ödünç veremez, üçüncü kişilere (birey, kurum, kuruluş, şirket vb.) kiralama gibi bedeller karşılığında veya bedelsiz olarak kullandıramaz ve bu hakkı üçüncü kişilere devredemez. 
Bu çerçevede, ARDIC tarafından Uygulama dahilinde kullanılan bilgi, içerik ve/veya yazılımların kopyalanması, çoğaltılması; bu bilgi, içerik ve/veya yazılımların işbu Koşullar'da belirtilen kapsam dışında kullanılması, dağıtılması, işlenmesi; 
Kullanıcı'nın Uygulama veya Web Sitesi ARDIC sistemlerinin güvenliğini tehdit edebilecek ve/veya Uygulama'ya, ARDIC'a ve diğer kullanıcılara zarar verebilecek faaliyetlerde bulunması;
Uygulamanın veya Web Sitesinin ve diğer yazılımların çalışmasını engelleyebilecek veya sistem veya Uygulamaya yukarıda belirtilen sorunlara yol açabilecek orantısız yük bindirecek girişimlerde bulunması;
Uygulama veya Web Sitesinde yayınlanan ve/veya Uygulamaya veya Web Sitesine başkaları tarafından girilen bilgilere veya yazılımın veya ARDIC sistemlerinin kaynak kodlarına yetkisiz erişim elde etmesi; 
söz konusu bilgileri kopyalama, kaldırma, değiştirme veya buna yönelik herhangi bir girişimde bulunması;
Uygulamanın ve/veya İnternet Sitesinin çalışmasını engelleyebilecek herhangi bir yazılım kullanma, bu yazılımları kullanmaya teşebbüs etme veya her türlü yazılım, donanım ve sunucuların işleyişini bozma, bu yazılım, donanım ve sunucuların bozulmasına neden olma, tersine mühendislik yapma, bu tür yazılımlara, donanımlara ve sunuculara herhangi bir şekilde saldırma, onları meşgul etme veya bunlara müdahale etme; veya ARDIC sunucularına erişmeye çalışması KESİNLİKLE YASAKTIR.
Kullanıcı, ARDIC, Uygulama ile yukarıda belirtilen şekillerde veya başka bir şekilde rekabet etmeyeceğini ve bunu yapmak isteyen üçüncü kişilere destek vermeyeceğini kabul eder. 
4.3.    Uygulamanın veya Web Sitesinin herhangi bir bileşeni, yazılı, sözlü ve/veya elektronik yollar dahil ancak bunlarla sınırlı olmamak üzere hiçbir mecrada yayınlanamaz ve/veya bunlara bağlantılar ARDIC'in izni olmaksızın verilemez.

5.    NFT Oluşturucu Bildirimi, NFT Risk Bildirimi

Hayli'yi NFT'ler ve/veya diğer herhangi bir kriptografik varlık oluşturmak, basmak, satmak, ticaretini yapmak veya başka bir şekilde dağıtmak için kullanıyorsanız, NFT'lerin fiyatları ve değeri önemli ölçüde dalgalanabilir. Kullanıcı, NFT'lerin satın alınması ve/veya satılmasıyla ilgili riskleri kabul eder ve tam olarak anlar.

6.    Sorumlulukların Sınırlandırılması

6.1.    Uygulama ve Web Sitesi, ARDIC tarafından “olduğu gibi” sunulmakta olup, ARDIC, Uygulama ve Web Sitesinin hatasız, kusursuz olduğu veya Kullanıcının kişisel ihtiyaçlarını karşıladığı konusunda herhangi bir iddia veya taahhütte bulunmamaktadır..
6.2.    ARDIC (i) Uygulamanın ve Web Sitesinin Kullanıcı tarafından kullanılmasından veya kötüye kullanılmasından, Kullanıcı'nın taahhüt ve yükümlülüklerini yerine getirmemesinden kaynaklanan sonuçlar ve zararlardan; bu tür bir başarısızlıktan kaynaklanabilecek özel, tesadüfi veya dolaylı zararlar; ortaya çıkan ekonomik zararlar; her türlü kar kaybı, veri kaybı, iş kaybı, itibar kaybı, beklenen tasarruf kaybı, gelir kaybı ve her türlü maddi ve manevi zararlar, üçüncü kişilerin tazminat taleplerinden; 
(ii) tüm donanım, sistem yazılımı/diğer yazılımlar ve ağla ilgili işlevler ve buna bağlı olarak ortaya çıkabilecek sorunlardan; 
(iii) ağ, internet bağlantısı, tasarım ve bağlantıdaki sorunlardan; 
(iv) Kullanıcı veya üçüncü kişiler tarafından Uygulama ve Yazılım üzerinde yapılabilecek her türlü değişiklik, güncelleme ve benzeri işlemleren;
(v) Voltaj dalgalanması, elektrik kesintileri, virüs saldırısı ve benzeri çevresel faktörlerden kaynaklanan hasarlardan sorumlu tutulamaz.
Kullanıcı, internet kesintisi başta olmak üzere, herhangi bir kesinti olması durumunda, Cihazını olağan şekilde hemen kullanamayabileceğini, Cihazın tekrar olağan halinde kullanılabilmesi için fabrika ayarlarına döndürülmesi gerekebileceğini; bu gibi durumlarda oluşabilecek başta veri kaybı olmak üzere herhangi bir kayıp veya zarardan ARDIC’ın sorumlu tutulamayacağını kabul eder.
6.3.    KULLANICI’NIN UYGULAMA VEYA WEBSİTESİNİ KULLANMASI YA DA HİZMETLERDEN YARARLANMASI İLE İLGİLİ HER TÜRLÜ RİSK MÜNHASIRAN KULLANICI ÜZERİNDE OLACAKTIR. KULLANICI, UYGULAMA VEYA WEBSİTESİNİN KULLANIMI VEYA DİĞER KULLANICILAR TARAFINDAN UYGULAMADA PAYLAŞILAN İÇERİKLERE İLİŞKİN OLARAK ARDIÇ’TAN HANGİ HAM ALTINDA OLURSA OLSUN HERHANGİ BİR ŞEKİLDE TALEPTE BULUNMAYACAĞINI, ARDIÇ’IN BU KAPSAMDA HERHANGİ BİR GARANTİ YA DA TAAHHÜT VERMEDİĞİNİ KABUL, BEYAN VE TAAHHÜT EDER. ARDIÇ, GEÇERLİ HUKUKUN İZİN VERDIĞI ÖLÇÜDE, KAR KAYBI, ŞEREFIYE VE İTİBAR KAYBI DAHİL ANCAK BUNLARLA SINIRLI OLMAKSIZIN UYGULAMANIN VEYA WEBSİTESİNİN KULLANIMI YAHUT KULLANICILAR’IN FİİLLERİ NEDENİYLE MEYDANA GELEN HİÇBİR DOĞRUDAN, DOLAYLI, ÖZEL, ARIZİ, CEZAİ ZARARDAN SORUMLU OLMAYACAKTIR. UYGULAMA VEYA WEBSİTESİ ÜZERİNDEN SUNULAN HİZMETLER VE SAİR İÇERİKLER “OLDUĞU GİBİ” SUNULMAKTA OLUP BU KAPSAMDA ARDIÇ’IN BUNLARIN DOĞRULUĞU, TAMLIĞI VEYA GÜVENİLİRLİĞİ İLE İLGİLİ HERHANGİ BİR SORUMLULUĞU YA DA TAAHHÜDÜ BULUNMAMAKTADIR. ARDIÇ, İŞBU KULLANIM KOŞULLARI KAPSAMINDA TİCARİ ELVERİŞLİLİK, BELLİ BİR AMACA VEYA KULLANIMA UYGUNLUK VEYA İHLALİN SÖZ KONUSU OLMAMASINA İLİŞKİN OLARAK AÇIK VEYA ZIMNİ HERHANGİ BİR TAAHHÜTTE BULUNMAMAKTADIR.
6.4.    Kullanıcı, Uygulama ve Websitesi üzerinden Ardıç’ın kontrolünde olmayan başka internet sitelerine ve/veya platformlara, dosyalara veya içeriklere link verilebileceğini, üçüncü taraflara ait hizmetlerin sunulabileceğini ve bu tür linklerin yöneldiği internet sitesini veya işleten/hizmeti veren kişiyi desteklemek amacıyla veya internet sitesi veya içerdiği bilgilere yönelik herhangi bir türde bir beyan veya garanti niteliği taşımadığını, söz konusu linkler vasıtasıyla erişilen platformlar, internet siteleri, dosyalar ve içerikler, hizmetler veya ürünler veya bunların içeriği hakkında Ardıç’ın herhangi bir sorumluluğu olmadığını kabul ve beyan eder.
6.5.    Kullanıcı, Uygulamaya ve Uygulama üzerinden sunulan hizmetlere erişimin ve bunların kalitesinin büyük ölçüde ilgili internet servis sağlayıcısından temin edilen hizmetin kalitesine dayandığını ve söz konusu hizmet kalitesinden kaynaklı sorunlarda Ardıç’ın herhangi bir sorumluluğunun bulunmadığını, Uygulamanın işleyişinin kusurdan ari olmadığını ve zaman zaman teknik aksaklıklar veya erişim engelleriyle karşılaşabileceğini kabul ve beyan eder.
6.6.    Profesyonel Tavsiye veya Sorumluluk Yoktur. ARDIC tarafından veya adına sağlanan tüm bilgiler yalnızca bilgilendirme amaçlıdır ve profesyonel, finansal veya yasal tavsiye olarak yorumlanmamalıdır. Bu Koşullarda yer alan veya ARDIC tarafından veya adına sağlanan herhangi bir bilgiye dayanarak herhangi bir işlem yapmamalı veya yapmaktan kaçınmalısınız. Hayli'yi ilgilendiren herhangi bir finansal, yasal veya diğer kararları vermeden önce, bu tür bir tavsiyenin uygun olacağı alanda lisanslı ve kalifiye kişilerden bağımsız profesyonel tavsiye almalısınız. Hayli aracılığıyla diğer Kullanıcılara veya üçüncü taraf bağlantılı web sitelerine herhangi bir kişisel bilgi verirken her zaman dikkatli olmalısınız. ARDIC, Kullanıcı İçeriğini kontrol etmez veya onaylamaz, Hayli'de bulunan herhangi bir üçüncü taraf içeriği, mesajı veya bilgisi ve ARDIC, Kullanıcı İçeriğinin herhangi bir Kullanıcı tarafından herhangi bir şekilde kullanılmasından veya kötüye kullanılmasından sorumlu olmayacaktır. ARDIC, Hayli ile ilgili olarak ve Hayli'yi kullanımınızdan kaynaklanan herhangi bir eylemle ilgili olarak özellikle sorumluluk kabul etmez.
6.7.    Blockchain Teknolojisine İlişkin Sorumluluk Reddi Beyanları. Yürürlükteki yasaların izin verdiği azami ölçüde ve burada açıkça belirtilen herhangi bir şeye bakılmaksızın, ARDIC aşağıdakilerle ilgili tüm sorumluluğu reddeder: 
(a) Blockchain Teknolojisinin Kullanımı. ARDIC, Hayli'yi sağlamak için jetonlar, kripto para birimleri, stablecoin'ler, "akıllı sözleşmeler", mutabakat algoritmaları, oylama sistemleri ve dağıtılmış, merkezi olmayan veya eşler arası ağlar veya sistemler dahil olmak üzere deneysel kriptografik ve blockchain teknolojilerini kullanır. Bu tür teknolojilerin yeni, deneysel ve spekülatif olduğunu ve bu nedenle işleyişi, etkileri ve riskleri ile mevcut yasaların bunlara uygulanması konusunda önemli belirsizlikler olduğunu kabul etmiş sayılırsınız. Yürürlükteki yasaların izin verdiği azami ölçüde, ARDIC yukarıda belirtilenlerle ilgili tüm sorumluluğu reddeder. 
(b) Blockchain Teknolojisinin Belirli Riskleri. Hayli'nin tesliminde kullanılan teknoloji, ARDIC'in kontrolü veya etkisi altında olmayan ve birçok risk ve belirsizliğe tabi olan ARDIC Destekli Blockchain'ler gibi halka açık eşler arası ağlara bağlıdır.ARDIC'in, belirli “akıllı sözleşmeleri” desteklemekten vazgeçmek ve yeni “akıllı sözleşmelere” destek eklemek dışında, bu teknolojileri değiştirme yeteneği sınırlı olabilir veya hiç olmayabilir. ARDIC bu Tahsil Edilebilir veya diğer geçerli dijital varlıklarla ilgili haklarınızı kullanabileceğinizi garanti etmez ve bundan sorumlu değildir.
(c) Akıllı Sözleşme Teknolojisinin Belirli Riskleri. NFT'ler ve burada yer alan içerik ve Hayli ile ilgili diğer dijital varlıklar, ARDIC Destekli Blok Zincirlerine uygulanan akıllı sözleşmelere bağlıdır ve bazıları ARDIC dışındaki kişiler tarafından kodlanabilir veya dağıtılabilir. ARDIC Destekli Blockchain(ler)e dağıtıldıktan sonra, akıllı sözleşmelerin kodu değiştirilemez.Uygulanabilir akıllı sözleşmeler, herhangi bir ARDIC Destekli Blockchain'in arızaları, hataları, kusurları, arızaları, bilgisayar korsanlığı, hırsızlık, saldırılar, ihmalkar kodlama veya tasarım seçimleri veya protokol kurallarındaki değişikliklerden olumsuz etkilenirse, tüm Koleksiyon Öğelerinin ve diğer ilgili dijital varlıkların tamamen kaybolması ve müsadere edilmesi riskine maruz kalabilirsiniz. 
(d) Varlık Fiyatları. ETH, Tahsil Edilebilir Ürünler ve diğer dijital varlıklar gibi varlıkların kamu piyasalarındaki fiat cinsinden fiyatları ve değeri, tarihsel olarak dramatik dalgalanmalara maruz kalmıştır ve oldukça değişkendir. Nispeten yeni ürünler ve teknolojiler olarak, blockchain tabanlı varlıklar, mal ve hizmetler için bir ödeme aracı olarak geniş çapta kabul görmemektedir. Bu varlıklara olan talebin önemli bir kısmı, blockchain varlıklarının kısa veya uzun vadeli elde tutulmasından kar elde etmek isteyen spekülatörler ve yatırımcılar tarafından üretilir. Herhangi bir ETH, Tahsil Edilebilir Öğe ve diğer dijital varlıkların piyasa değeri, bu tür varlıkları Hayli aracılığıyla veya başka herhangi bir platformda edindiğiniz fiyatın altına düşebilir. Kriptografik ve blok zinciri tabanlı sistemlerle işlem yapma maliyetlerinin ve hızlarının değişken olduğunu ve herhangi bir zamanda önemli ölçüde artıp azalabileceğini, bunun sonucunda herhangi bir ETH'ye veya diğer kripto para birimine, Tahsil Edilebilir Öğelere veya Hayli ile ilişkili diğer dijital varlıklara uzun süre erişememe veya bunları kullanamama ile sonuçlanabileceğini kabul ediyor ve kabul ediyorsunuz.
(e) Düzenleyici Belirsizlik. Blockchain teknolojileri ve dijital varlıklar, birçok yasal ve düzenleyici belirsizliğe tabidir ve Hayli, Collectibles ve diğer dijital varlıklar, bir veya daha fazla düzenleyici veya yasal soruşturma, eylem, dava, soruşturma, iddia, para cezası veya yargılamadan olumsuz etkilenebilir ve bu, bu tür varlıkları ve teknolojileri kullanmaya ve bunlardan yararlanmaya devam etme kabiliyetinizi engelleyebilecek veya sınırlayabilecektir.
(f) Kriptografi Riskleri. Kriptografi ilerleyen bir alandır. Kod kırmadaki ilerlemeler veya kuantum bilgisayarların geliştirilmesi gibi teknik ilerlemeler, ARDIC Destekli Blockchain(ler), Hayli, Collectibles ve diğer dijital varlıklar için, bunların çalınması, kaybolması veya erişilemezliği dahil olmak üzere riskler oluşturabilir.
(g) Fork (Çatal) Kullanımı. Hayli, ARDIC Destekli Blok Zincirleri, NFT'ler, Koleksiyon Ürünleri ve diğer dijital varlıkların belirli unsurları "çatallara" tabi olabilir. Çatallar, belirli bir blockchain sistemi için yazılım istemcilerini çalıştıran kişilerin bir kısmı veya tümü, yeni bir istemciyi veya mevcut bir istemcinin yeni bir sürümünü benimsediğinde ortaya çıkar: 
(i) protokol kurallarını geriye dönük uyumlu veya geriye dönük uyumsuz bir şekilde değiştirerek sonraki bloklara hangi işlemlerin eklenebileceğini, blok zincirine daha sonra blokların nasıl ekleneceğini veya protokolün gelecekteki işleyişiyle ilgili diğer konuları etkiler; veya
(ii) blok zincirinin geçmişini değiştirmek için geçmiş blokları yeniden düzenler veya değiştirir. Bazı çatallar tartışmalıdır ve bu nedenle, protokolün veya blok zincirinin iki veya daha fazla kalıcı alternatif versiyonuyla sonuçlanabilir; bunların her ikisi de orijinalin meşru veya gerçek devamı olarak görülebilir veya böyle olduğu iddia edilebilir. ARDIC, çatallanmaların oluşmasını veya sonucunu tahmin edemeyebilir, kontrol edemeyebilir veya etkileyemeyebilir ve bunlarla bağlantılı olarak herhangi bir risk, yükümlülük veya yükümlülük üstlenmez. Yukarıda belirtilenlerin genelliğini sınırlamaksızın, ARDIC bekleyen, tehdit altındaki veya tamamlanmış çatallanmaları size bildirmekle ilgili herhangi bir sorumluluk üstlenmez. ARDIC, bu tür çatallara yanıt(lar)ını, bu tür bir yanıt (veya böyle bir yanıtın olmaması) için size karşı herhangi bir görev veya yükümlülük veya yükümlülük olmaksızın, yegane ve mutlak takdirine göre belirleyecektir. ARDIC, yalnızca bir NFT'nin Koleksiyonu oluşturan ilgili meta verilerle ilişkilendirilmesine izin verme hakkını saklı tutar, ancak bu tür NFT'lerin kopyaları bir çatalın ardından her iki zincirde de bulunabilir. Olası çatallanmalardan bağımsız olarak haberdar olmak ve bunlardan haberdar olmak ve bununla bağlantılı olarak kendi çıkarlarınızı yönetmek için tüm sorumluluğu üstleniyorsunuz. Kullanıcı, Uygulama ve Web Sitesi ile Uygulama üzerinden sağlanan içeriklerin kullanılabilirliğinin ve kalitesinin büyük ölçüde ilgili İnternet Servis Sağlayıcının sunduğu hizmetin kalitesine bağlı olduğunu ve bu hizmet kalitesinden doğacak sorunlardan ARDIC'in sorumlu olmadığını, Yazılım ve Uygulamanın işleyişinin hatasız olmadığını, zaman zaman arızalar veya erişim engelleri olabileceğini bildiğini kabul ve beyan eder.
6.8.    Yaş sınırlamaları, ebeveynlerin ve vasi sorumluluğu: Kullanıcı, Hayli ve ARDIC hizmetlerine erişerek en az 17 yaşında olduğunu ve Kullanıcının ülkesindeki minimum dijital rıza yaşını karşıladığını onaylar. ARDIC, Kullanıcının yaşının doğru olduğunu garanti edemez. Kullanıcı, ülkesindeki ARDIC hizmetlerine erişebilecek yaştaysa, ancak Hayli şartlarını kabul etme yetkisine sahip olacak yaşta değilse, Kullanıcının ebeveyni veya vasisi, Kullanıcı adına şartları kabul etmelidir. Bir ebeveyn veya yasal vasiyseniz ve gencin Hayli'yi kullanmasına izin veriyorsanız, bu şartlar sizin için de geçerli olur ve gencin Hayli'deki faaliyetlerinden siz sorumlu tutulursunuz.
Kullanıcı içeriği Kullanıcı'ya aittir, ancak Kullanıcı, Hayli'yi kullandığında Hayli ve ARDIC'e bir lisans verir. Kullanıcı içeriği belirli fikri mülkiyet haklarıyla korunuyor olabilir. Hayli bunlara sahip olmaz. Ancak Kullanıcı, Hayli'yi kullanarak, Hayli'ye, ARDIC hizmetlerinin işletilmesi, geliştirilmesi ve iyileştirilmesi ile bağlantılı olarak, ilgili yasal gerekliliklere uygun olarak, Kullanıcı içeriğiyle aşağıdakileri yapması için bir lisans verir - bu bir tür izindir:
Kullanıcı içeriğini Hayli'nin kullanımına uygun şekilde kullanmak, kopyalamak, depolamak, dağıtmak ve iletmek. (Örneğin, Hayli Kullanıcı içeriğini saklayabilir ve görüntüleyebilir.)
Kullanıcı içeriği başkalarına görünür kılmayı seçerse, Kullanıcı içeriğini yayınlayabilir, herkese açık olarak gerçekleştirebilir veya herkese açık olarak görüntüleyebilirsiniz. (Örneğin, Hayli Kullanıcı mesajlarını, Kullanıcı bunları genel sunuculara gönderirse görüntüleyebilir.)
Kullanıcı içeriğini izleyebilir, değiştirebilir, çevrilebilir ve yeniden biçimlendirilebilir.
ARDIC hizmetlerinin amaçlandığı gibi çalışmasına izin vermek için içeriğinize alt lisans verebilirsiniz. (Örneğin, içeriğinizi bulut hizmeti sağlayıcılarımızda depolayabilmemiz için.)
Bu lisans dünya çapındadır, münhasır değildir (bu, içeriğinizi başkalarına lisanslayabileceğiniz anlamına gelir), telifsiz (bu lisans için herhangi bir ücret alınmadığı anlamına gelir), devredilebilir ve kalıcıdır.
ARDIC, bu şartların, Topluluk İlkelerimizin, diğer politikalarımızın veya geçerli herhangi bir yasa veya düzenlemenin ihlali dahil olmak üzere herhangi bir nedenle içeriğinizi engelleme, kaldırma ve/veya kalıcı olarak silme hakkını saklı tutar.

7.    Kullanımın Askıya Alınması ve Sonlandırılması

7.1    Kullanıcı’nın işbu Kullanım Koşullarında yer alan hükümlere ve beyan edilen kural ve şartlara uymaması; Kullanıcı’nın faaliyetlerinin hukuki, teknik veya bilgi güvenliği anlamında risk oluşturması ya da üçüncü kişilerin şahsi ve ticari haklarına halel getirici mahiyette olması halleri dahil olmak üzere herhangi bir nedenle ya da neden göstermeksizin Ardıç, Kullanıcı’nın Uygulamayı kullanımını geçici veya sürekli olarak durdurabilir yahut işbu Kullanım Koşulları’nı derhal feshedebilir. Kullanıcı, bu nedenle Ardıç’tan herhangi bir talepte bulunamayacaktır. 
7.2    ARDIC dilediği zaman işbu Kullanım Koşulları’nı süreli veya süresiz olarak askıya alabilecek, sona erdirebilecektir.

8.    İhtilafların Giderilmesi

Bu Koşullar ile ilgili olarak doğabilecek ihtilaflara ilişkin olarak; burada belirtilen hükümler, bu tür hükümlerin bulunmaması halinde Türkiye Cumhuriyeti kanunları uygulanacaktır. İşbu Koşullar'ın uygulanmasından doğacak her türlü ihtilafta İstanbul Merkez (Çağlayan) Mahkemeleri ve İcra Daireleri yetkili olacaktır.

9.    Diğer Hükümler

9.1    Mücbir sebep sayılan tüm durumlarda, ARDIC işbu Kullanım Koşulları ile belirlenen edimlerinden herhangi birini geç veya eksik ifa etme veya ifa etmeme nedeniyle sorumlu tutulamaz. Mücbir sebep; doğal afet, isyan, savaş, grev, lokavt, telekomünikasyon altyapısından kaynaklanan arızalar, elektrik kesintisi ve kötü hava koşulları da dahil ve fakat bunlarla sınırlı olmamak kaydıyla ilgili Tarafın makul kontrolü haricinde gerçekleşen olaylar olarak yorumlanacaktır. Mücbir sebep süresince Tarafların edimleri askıya alınacaktır. Mücbir sebebin 1 (bir) aydan uzun sürmesi halinde işbu Sözleşme hakları ifa edilemeyen Tarafça feshedilebilecektir.
9.2    Kullanıcı, işbu Kullanım Koşulları’nı ve/veya Kullanım Koşulları’ndan kaynaklanan hak ve yükümlülükleri Ardıç’ın açık yazılı onayı olmaksızın üçüncü kişilere devredemeyecektir. Ardıç işbu Kullanım Koşulları’nı, Kullanım Koşulları’ndan kaynaklanan hak ve yükümlülükleri üçüncü kişilere devretme hakkına sahiptir.
9.3    İşbu Kullanım Koşulları kapsamında meydana gelebilecek uyuşmazlıklarda HMK madde 193 uyarınca ARDIC’ın kayıtları (elektronik ortamda tutulan kayıtlar dahil) delil kabul edilecektir.
9.4    ARDIC, işbu Koşullar'ı ve bu Koşullar'ın eki olan Gizlilik Politikası'nı ve Uygulama'da yayınlanan diğer koşulları dilediği zaman tek taraflı olarak değiştirme yetkisine sahiptir. Kullanıcı, bu tür belgeleri düzenli olarak izlemekle yükümlüdür..
